According to the Gambit, many of Brown’s writings are either direct quotes or near quotes from earlier publications and are not attributed. To determine if the use was plagiarism, they called in Jonathan Bailey, who provided an analysis of some of the quotes and was featured heavily in the column.

Jonathan Bailey is a New Orleans businessman whose company, Copybyte, specializes in detecting plagiarism in journalism and academia. Gambit sent Bailey four representative samples from Brown’s columns, along with text from the originals to which they bore a resemblance. Three of the four were, in Bailey’s opinion, “pretty clear-cut examples of plagiarism — clearly copy-and-paste jobs with minor rewritings.”

Guttenplan interviewed Jonathan to talk about perceptions of plagiarism across the globe, especially comparing Germany’s views to that of the U.S. and elsewhere. From the article:

Jonathan Bailey, a consultant in New Orleans who runs the Web site “Plagiarism Today,” agrees. “There’s a lot of cultural differences in how people respond to plagiarism,” he said.

In the former republics of the Soviet Union, “people grew up with a very strong idea that intellectual property was community property. So there is still real resistance to the idea that words belong to anyone,” Mr. Bailey said. In many developing countries, a formal or legal prohibition against plagiarism “comes up against their desire to become a power in the global scientific community,” he said.

The article, entitled, “When is Self-Plagiarism Ok?” delves into the murky waters of when is it ok to copy yourself and, though answers are hard to come by, it is clearly a thorny issue facing the scientific community.

Jonathan’s blog Plagiarism Today was featured on Entrepreneur.com, the Web site of Entrepreneur Magazine, on their “Making it Legal Blog”.

The article dealt with the legal issues surrounding the overlap in intellectual property law when it comes to logos, specifically how they can be protected by both copyright and trademark at the same time. The article featured a post on the topic posted on Plagiarism Today that has been receiving a great deal of attention on the Web.

Jonathan, along with host Denise Howell and fellow panelists Alex Macgillivray and Kevin Thompson sat down to record This Week in Law on the TWiT network. The episode covered a wide variety of topics including copyright, privacy and other internet law related issues.

Topics of special importance were the new DMCA exemptions, several new lawsuits in the adult content industry and questions about how copyright applies to work-related creations made in your spare time.

Earlier this week, I gave an interview on KOA Radio in Denver regarding the Scott McInnis plagiarism scandal. McInnis, who is a Republican candidate for governor in the state, has been rocked by two different plagiarism allegations, the first regarding research he was paid for in the 90s and the second regarding a newspaper column and speech he submitted before then.
