Earlier this week, I gave an interview on KOA Radio in Denver regarding the Scott McInnis plagiarism scandal. McInnis, who is a Republican candidate for governor in the state, has been rocked by two different plagiarism allegations, the first regarding research he was paid for in the 90s and the second regarding a newspaper column and speech he submitted before then.

You can listen to my interview on the topic by visiting the show’s podcast page. My interview is in the 7-14-10 edition (or you can just search for “Jonathan Bailey”) and it begins at about 18 minutes into the show.

A big thanks to KOA for having me on!

If you need to verify content from your staff/contractors or operate a social content site, CopyByte can help.

One of the most common sources of copyright troubles companies and individuals face is from content they’ve acquired. Far too often, content that is offered for acquisition turns out to be infringing.

This leaves the consumer both to clean up the mess of the infringement and leaves them short the resources they spent to acquire the content.

Whenever you receive content, it is important to protect yourself and your interests. One of the best ways to do that is to have someone working for you to help you verify the authenticity of the content you purchase and also develop strategies for handling any issues that may arise if the acquired work is found to be infringing.

Fortunately, CopyByte is able to provide many such services and can help you find peace of mind when dealing with content brought in from outside sources.

CopyByte’s services in this area include.

General Consulting

CopyByte can help you devise and implement a strategy for verifying the authenticity of received works while keeping both the delay, time invested and risk to a minimum. We also provide consulting for companies that are receiving works from users, such as social networking/news sites regarding how to handle cases of alleged infringement and streamline the process. We can also help craft effective terms of service that protect your company’s interests while being both fair and clear to your users.

Plagiarism Analysis

If you are preparing to make a large purchase and wish to verify the authenticity of the work, CopyByte can help. We have performed plagiarism analyses for a variety of functions including on sites with thousands of pages, novel-length works, academic papers and more. We can also perform analyses on a variety of types of content including text, images and video.

All of our analyses are professional, thorough, discreet and implement a mixture of the latest technology and expert human analysis.

Content Location

CopyByte can even help locate content for your purpose including text, images and multimedia works. We can help you navigate the maze of licenses to find content that you can use for your project that is both affordable and of high quality. If needed, we can also assist with licensing negotiations.

Copyright is one of the biggest sources of headaches for abuse teams. CopyByte can help change that.

For Web hosts, copyright can be a veritable minefield.

Though the law is fairly clear on what the responsibilities are for Web hosts, especially when it comes to removing allegedly infringing materials, it is extremely unclear as to how to meet those responsibilities.

Unfortunately, copyright complaints bring a series of challenges that are unique in its particular area of abuse. Not only are there challenges in meeting the requirements of the law, but in making the process as streamlined as possible while avoiding upsetting customers.

In short, copyright issues can be a serious headache for Web hosts. Not having a well thought out strategy to handle these issues can often end in the loss of time, money and customers while doing little to appease copyright holders. What is needed is a simple, efficient system that processes complaints quickly and handles them in a way that helps your customers understand the situation.

Fortunately, CopyByte is here to help with consulting solutions that can take much of the pain out of copyright complaints. Our services include:

DMCA Takedown Consulting

At CopyByte, we have filed over 1000 DMCA notices and worked with hundreds of different hosts. We know the DMCA process inside and out and can help you not only follow best practices within the industry but streamline the process to save you time, money and headache.

We can also help ensure that your customer-facing DMCA process is adequate and does a good job in educating your customers about the situation, ensuring that they stay your clients and don’t become repeat offenders.

Managed DMCA Solutions

The DMCA requires that you have a designated contact to receive notices of copyright infringement, process them and ensure that the allegedly infringing material is removed expeditiously. However, many Web hosts do not have the resources or the need to hire a full-time person for this purpose.

CopyByte can help you by providing such a contact. This solution is much more cost-efficient than hiring a full-time staff member or a law firm and is better able to respond than a regular abuse team member without copyright expertise.

DMCA Enforcement Testing

DMCA enforcement is a critical element of any Web host’s abuse process and it is important that it be handled well every time. After all, just one mishandled notice can result in a lawsuit with severe consequences for your company.

At CopyByte, we can put your DMCA and other abuse procedures to the test by filing notices against dummy accounts created by CopyByte for testing purposes, we can test the response time, effectiveness and courtesy of the entire DMCA process. This allows us to examine both the complainant’s side of the process as well as the customer’s to find any weaknesses that need to be addressed.

Contact Us

If you feel that CopyByte can help you in any way, please contact us and let us know. We will be happy to discuss your situation and find ways that CopyByte can assist you.
